Eminent Domain Appraisal

While the process of eminent domain can create anxiety and frustration for landowners and difficult decisions for condemning authorities, Chapter 32 of Wisconsin Statutes provides a road map through the process and framework to protect landowner rights while facilitating and enabling public projects to move forward.

In particular, state law provides that landowners have the right for any offer made by a condemning authority to be based on an appraisal, detailing the valuation of their property and identifying the loss and damages associated with acquired land and the remainder. In addition, the landowner has the right to obtain a second opinion of loss and damage by a competent appraiser of their choice. If completed within 60 days of receipt of the original offer and submitted to the condemning authority, the “reasonable cost” of that second opinion will be reimbursed by the condemning authority.
